Civil litigation can be a minefield for the unwary. It can often be difficult, risky and stressful. When individuals are involved, these problems become magnified, especially if the dispute is family-related. Therefore, it is not surprising that many of these civil cases are settled at or prior to the hearing. Any settlement requires compromise on both sides, but at least it offers the parties an outcome that they can control, and ends the litigation process.
Taxation implications can materially affect the value of compensation received by a plaintiff from a settlement or a determination by the Court.
Awareness of these taxation implications may facilitate the drafting of settlement terms in such a manner that brings the parties together in circumstances where they may not have otherwise been prepared to compromise.
In matrimonial disputes, taxation implications and CGT relief provisions are more often than not, central to the achievement of an out-of-court property settlement.
Proposals for the settlement of disputes are often personal and driven by emotional or subjective considerations. As a consequence, there is often inadequate attention paid to the taxation considerations arising from the proposed terms of settlement.
